Applying for issuance of visa and the rules of visa issuance
In accordance with the requirements of existing legislation (all other, except citizens of countries having mutual agreement on visa free entry and exit), foreigners and stateless persons can enter and leave a country on the basis of their valid personal passports and official permission – visa.
 For that purpose, foreigners and stateless persons have to apply to diplomatic missions and consulates of the Republic of Azerbaijan in a foreign country by indicating the purpose and duration of their travel.
The list of documents required for visa issuance, application form, the amount and payment method of a state duty, as well as information about diplomatic missions and consulates of the Republic of Azerbaijan in the third countries where foreigners and stateless persons, living in the countries where there is not diplomatic mission and consulate of the Republic of Azerbaijan, will apply for visa issuance are located in the official web pages of proper bodies of executive power, diplomatic missions and consulates of the Republic of Azerbaijan in foreign countries and on the boards in front of their buildings where can be seen well.
When visa issuance is rejected, grounded information about that is provided.
Foreigners and stateless persons may make administrative complaint and/or lawsuit in accordance with the legislation of the Republic of Azerbaijan due to the bureaucracy in processing and refusal of an application for visa issuance.
In accordance with Article 37.2 of the Migration Code (in certain cases determined by proper body of executive power foreigners and stateless persons may obtain a visa in the territory of the Republic of Azerbaijan) and cases mentioned in the Decree of the President of the Republic of Azerbaijan “on changes in the process of issuance of entry visas to foreigners and stateless persons coming to the Republic of Azerbaijan” dated September 13, 2010 N 326, foreigners and stateless persons may apply to visa departments at proper international airports of the Ministry of Foreign Affairs of the Republic of Azerbaijan and can get a visa.
  • Visa department of Consular Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan at the International Airport named after Haydar Aliyev;
  • Visa department at the International Airport in Nakhchivan of the department in Nakhchivan Autonomous Republic of the Ministry of Foreign Affairs of the Republic of Azerbaijan;
  • Visa department at Ganja International Airport of Consulate Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan;
  • Visa department at Lankaran International Airport of Consulate Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan;
  • Visa department at Gabala International Airport of Consulate Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan;
  • Visa department at Zagatala International Airport of Consulate Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan.
Applications of foreigners and stateless persons on visa issuance will be processed during not more than fifteen days after they applied, but in the cases determined by proper bodies of executive power, at the same time when visit of foreigners and stateless persons is for treatment purposes, or connected with serious illness or death of a close relative living in the Republic of Azerbaijan (by submitting proper document approving these facts), it is processed within not more than two business days.
In accordance with Article 7 of the Agreement on simplification of visa issuance procedure between the Republic of Azerbaijan and European Union” processing period of visa applications is applied in the following way:
  1. Diplomatic missions and consulates of Member States and the Republic of Azerbaijan make a decision related to visa issuance application within 10 calendar days after the date of receipt of an application and required documents for visa issuance.
  2. Period of decision related to visa application may be prolonged for 30 calendar days in individual cases, especially when there is a need for addition investigation on the application.
  3. Period of decision related to visa application may be decreased to 2 working days or to a period less than it in urgent cases.
When applicants are required to make an appointment for submitting an application, such kind of appointment is made within two weeks after the date of an application for an appointment. However, third party contractors regularly ensure urgent submission of visa applications.
In well-grounded urgent cases, consulate creates an opportunity for an applicant to submit his/her application before an appointment or an appointment is made immediately.

Countries applying the visa-free regime
At present in accordance with bilateral intergovernmental agreements, visa free regime is being applied on the basis of reciprocity between the Republic of Azerbaijan and the following countries:
I group
  • Citizens of the Republic of Azerbaijan and relevant foreign country holding diplomatic or service (or official/special) passport

II group
Countries with visa free regime for:
  • Citizens holding any type of valid passport giving a right to cross a border in accordance with the legislation of the Republic of Azerbaijan and relevant foreign country – as well as diplomatic, service (or official/special) or regular passport;
  • Also citizens travelling with these persons, but not holding valid passport, and whose photo, name, surname, patronymic officially indicated in their passports;
  • Stateless persons having relevant identification document that is given to specially stateless persons by the government bodies of the Republic of Azerbaijan or by the relevant foreign country for border crossing purposes;
  • Citizens and stateless persons holding temporary border crossing document – repatriation certificate given to persons when the passport is lost, stolen, became worthless or validity period is expired for only to return for a short period to the country which is the citizen of or where he/she lives permanently.

Documents required for visa issuance
In accordance with article 36 of the Migration Code of the Republic of Azerbaijan, the following documents are required for visa issuance:

36.1.1. Sample of application form approved by an appropriate authority of executive power (a sample is attached); Visa application form can be fill electronically eapplication.mfa.gov.az;


36.1.2. Passport or other travel document (a validity period of a passport or other travel document should exceed a validity period of an expected visa at least by 3 months) and copies of their main pages;
 
36.1.3. Two color photographs (3x4cm) matching with biometric identification requirements;

36.1.4. A copy of medical insurance certificate (if a host does not undertake to pay for medical services);

36.1.5. Document certifying payment of a state duty for visa issuance;

36.1.6. Application submitted by a party inviting a foreigner and a stateless person to the Republic of Azerbaijan, a sample (a sample is attached) of which is approved by an appropriate authority of the executive power, a registered copy of a certificate (for non-governmental organizations), a document proving the purpose of an invitation (these documents are not required for transit, tourism, official and personal travel visas);

36.1.7. Relevant documents set forth in articles 25-34 of this Code, depending on the purpose of travel.
 
36.2. In addition to the documents set forth in article 36.1 of this Code a notarized copy of a birth certificate, a permission of parents or a legitimate representative and copies of identification documents are required for issuance of visa to foreigners and stateless persons under 18 holders of a passport travelling without his/her parent or a legitimate representative.


36.3. An amount of a state duty for visa issuance is determined by an appropriate law of the Republic of Azerbaijan. State duty for visa issuance is not reimbursed regardless the result of processing of apply.


Following documents shall be submitted for visa issuance at a visa section of  the Consular Department of the Ministry of Foreign Affairs of the Republic of Azerbaijan at the International Airport named after Haydar Aliyev;  visa sections of the Ministry of Foreign Affairs of the Republic of Azerbaijan at the International Airport in Nakhchivan Autonomous Republic, at Ganja International Airport; at Lankaran International Airport; at Gabala International Airport; at Zagatala International Airport of the Republic of Azerbaijan:
  • 1 application form (sample is attached);
  • A passport of a foreigner and an identity card of a stateless person;
  • A receipt about payment of state duty for visa issuance.

Attention! A validity period of a passport or other travel document should exceed a validity period of an expected visa at least by 3 months.
Exemptions from payment of visa fees
In accordance with article 17.2 of the Law of the Republic of Azerbaijan dated 2001 “On State fee” the following category foreigners and stateless persons visiting the Republic of Azerbaijan are exempted from visa fee:
  • Members of government representation and official persons;
  • Representatives of international humanitarian organizations in the Republic of Azerbaijan;
  • Studying and engaging in teaching activities with government support;
  • Travelling with defence line.
Citizens of the following countries are issued visa free of charge.
  1. In accordance with agreement between the Republic of Azerbaijan and the Republic of Turkey, the citizens of the Republic of Turkey holding regular passports:
  • Free of charge at diplomatic missions and consulates of the Republic of Azerbaijan;
  • USD 10 at international airports of the Republic of Azerbaijan.
  1. All types of visas are issued free of charge to citizens of Japan holding regular passports.
  2. A visa for a period of 15 days are issued free of charge to citizens of Pakistan Islamic Republic holding regular passports.
 
In accordance with article 6 of the Agreement between the Republic of Azerbaijan and European Union “On simplification of visa issuance”, duties for processing visa applications are applied in the following way:
  1. Fee for processing visa applications is EURO 35. The abovementioned amount may be reviewed again in accordance with a procedure stipulated in article 14 (4).
  2. Without prejudice to the 3rd paragraph, the following persons are exempted from visa application processing fee:
  • Close relatives – husband or wife, children (including adopted children), parent (including guardians), grandpas, grandmothers and grandchildren of the citizens of European Union legally living in the territory of the Republic of Azerbaijan or the citizens of the Republic of Azerbaijan legally living at Member States or the citizens of European Union living in the territory of Member State the citizen of which they are or the citizens of the Republic of Azerbaijan living in the territory of the Republic of Azerbaijan;
  • Members of official delegation, as well as permanent members participating in official meetings, consultations, negotiations or exchange programs, as well as events organized in the territory of the Republic of Azerbaijan or one of Member States, with the invitation sent to Member States, European Union or the Republic of Azerbaijan;
  • Pupils, students, doctorates and accompanying teachers travelling for exchange programs, as well as education and teaching courses and other school related activities;
  • People with disabilities and when necessary persons accompanying them;
  • Participators of international sport events and persons professionally accompanying them;
  • People participating at cultural and art events including university and other exchange programs;
  • People submitting documents confirming necessity of their travel, including urgent medical treatment, to participate at the funeral of close relative and visit close relative who is seriously ill and persons accompanying them;
  • Representatives of civil society organizations travelling for educational courses, seminars, conferences including exchange programs;
  • Pensioners;
  • Children under 12 years old;
  • Journalists and technical staff professionally accompanying them.
  1. When Member States or the Republic of Azerbaijan cooperates with third party contractor for visa issuance, the third party contractor can charge fee for its services. This fee has to be proportionate to expenditures of third party contractor and must not be over than EURO 30. Member States and the Republic of Azerbaijan should provide the applicant with a right to send their applications directly their consulates.
Third party contractor executes its operations for a Union in accordance with Visa Code and fully observing legislation of the Republic of Azerbaijan.

  • Close relatives – husband or wife, children (including adopted children), parent (including guardians), grandpas, grandmothers and grandchildren of the citizens of European Union legally living in the territory of the Republic of Azerbaijan or the citizens of the Republic of Azerbaijan legally living at Member States or the citizens of European Union living in the territory of Member State the citizen of which they are or the citizens of the Republic of Azerbaijan living in the territory of the Republic of Azerbaijan;
  • Members of official delegation, as well as permanent members participating in official meetings, consultations, negotiations or exchange programs, as well as events organized in the territory of the Republic of Azerbaijan or one of Member States, with the invitation sent to Member States, European Union or the Republic of Azerbaijan;
  • Pupils, students, doctorates and accompanying teachers travelling for exchange programs, as well as education and teaching courses and other school related activities;
  • People with disabilities and when necessary persons accompanying them;
  • Participators of international sport events and persons professionally accompanying them;
  • People participating at cultural and art events including university and other exchange programs;
  • People submitting documents confirming necessity of their travel, including urgent medical treatment, to participate at the funeral of close relative and visit close relative who is seriously ill and persons accompanying them;
  • Representatives of civil society organizations travelling for educational courses, seminars, conferences including exchange programs;
  • Pensioners;
  • Children under 12 years old;
  • Journalists and technical staff professionally accompanying them.
  1. When Member States or the Republic of Azerbaijan cooperates with third party contractor for visa issuance, the third party contractor can charge fee for its services. This fee has to be proportionate to expenditures of third party contractor and must not be over than EURO 30. Member States and the Republic of Azerbaijan should provide the applicant with a right to send their applications directly their consulates.
Third party contractor executes its operations for a Union in accordance with Visa Code and fully observing legislation of the Republic of Azerbaijan.

Exemptions from payment of visa fees
 
In accordance with article 17.2 of the Law of the Republic of Azerbaijan dated 2001 “On State fee” the following category foreigners and stateless persons visiting the Republic of Azerbaijan are exempted from visa fee:
 
  • Members of government representation and official persons;
  • Representatives of international humanitarian organizations in the Republic of Azerbaijan;
  • Studying and engaging in teaching activities with government support;
  • Travelling with defence line.
Citizens of the following countries are issued visa free of charge.
  1. In accordance with agreement between the Republic of Azerbaijan and the Republic of Turkey, the citizens of the Republic of Turkey holding regular passports:
  • Free of charge at diplomatic missions and consulates of the Republic of Azerbaijan;
  • USD 10 at international airports of the Republic of Azerbaijan.
  1. All types of visas are issued free of charge to citizens of Japan holding regular passports.
  2. A visa for a period of 15 days are issued free of charge to citizens of Pakistan Islamic Republic holding regular passports.
 
In accordance with article 6 of the Agreement between the Republic of Azerbaijan and European Union “On simplification of visa issuance”, duties for processing visa applications are applied in the following way:
  1. Fee for processing visa applications is EURO 35. The abovementioned amount may be reviewed again in accordance with a procedure stipulated in article 14 (4).
  2. Without prejudice to the 3rd paragraph, the following persons are exempted from visa application processing fee:

Responsibilities and restrictions defined by legislation

In accordance with article 16 of the Migration Code, entry of a foreigner and a stateless person into the Republic of Azerbaijan is forbidden in the following cases:

16.1. Entry of foreigners and stateless persons into the Republic of Azerbaijan is prohibited when:

16.1.1. It is required for protection of national security or public order; or rights and legal interests of citizens of the Republic of Azerbaijan and others;

16.1.2. There is information that a person has committed terrorism, financing of terrorism and war crimes against peace and humanity or he/she is a member of a transnational organized criminal group;

16.1.3. A person is imprisoned for committing a crime against citizens of the Republic of Azerbaijan or interests of the Republic of Azerbaijan, if his/her imprisonment has not been served or annulled in a manner stipulated by the law;

16.1.4. A person has been expelled from the Republic of Azerbaijan previously and if the restriction period to his/her entry to the country has not been ended;

16.1.5. Person’s stay is considered undesirable in the Republic of Azerbaijan;

16.1.6. A person violated declared purposes of visiting the country during his/her previous stay in the Republic of Azerbaijan;

16.1.7. A person gives false information about himself/herself or on the purpose of his/her travel, when submitting an application for entry to the Republic of Azerbaijan;

16.1.8. A person has been brought to administrative responsibility twice or more in the last 3 years for violating migration legislation;

16.2. In cases, set forth in Articles 16.1.6 – 16.1.8 of this Code, entry of foreigners and stateless persons to the Republic of Azerbaijan is prohibited for 5 years.

16.3. In cases, set forth in Article 16.1 of this Code, the information on foreigners and stateless persons is entered to the watch list of the “Entry-Exit and Registration” Interagency Automated Data-Search System in a defined way and the active status of that information should be updated when the relevant grounds are removed.

 

Foreigners and stateless persons violating requirements of the Migration Code and trying to cross borders of the Republic of Azerbaijan without a passport, a visa or with invalid passport or other documents are not allowed to enter territory of the Republic of Azerbaijan and sent back to a country where they have come from.

Foreigners and stateless persons trying to cross state borders with false documents or with documents belonging to other persons are brought to a responsibility in a manner stipulated by a law.

In accordance with article 17 of Migration Code of the Republic of Azerbaijan, exit of foreigners and stateless persons from the Republic of Azerbaijan can be restricted temporarily in the following cases:

17.1. Exit of foreigners and stateless persons from the Republic of Azerbaijan can be temporarily restricted when:

17.1.1. Their exit is contrary to the interest of national security - until that reason is eliminated;

17.1.2. They are arrested or imposed any pre-trial restraint in compliance with the Code of Criminal Procedure of the Republic of Azerbaijan - until they are released, pre-trial restriction is ended or is abolished;

17.1.3. They are imprisoned - until they complete serving their major punishment defined in the Criminal Code of the Republic of Azerbaijan or they are released from the punishment except the case set forth in Article 17.1.5 of this Code;

17.1.4. In case, compulsory medical measures are imposed on them in compliance with the Code of Criminal Procedure of the Republic of Azerbaijan, until the application of these measures is abolished;

17.1.5. In case, suspended sentence is imposed on him/her by charging with the obligations set forth in the Criminal Code of the Republic of Azerbaijan or if she/he is released on parole, respectively till the end of the probation period or non-served part of the punishment, or till earlier and complete termination of the suspended sentence or the charged obligations;

17.1.6. In case of existence of court decision legally entered into force on temporary restriction of citizens’ right to leave the country for not executing of the court order given upon the court decision because of unexcused reasons within a period defined for voluntary execution – till the adoption of decision on removal of restriction;

17.1.7. In case, they commit an administrative offence - until the execution of administrative punishment measures on them which are legally in force.

17.2. Not conducting of prophylactic vaccinations in a way as defined in the legislation results in restriction of entry and exit right of foreigners and stateless persons permanently residing in the Republic of Azerbaijan to/from countries where prophylactic vaccinations are required, in compliance with international medical sanitary rules or the international agreements that the Republic of Azerbaijan is a party to.

17.3. In the cases, set forth in Articles 17.1 and 17.2 of this Code, information on foreigners and stateless persons should be entered in the watch list of “Entry-Exit and Registration” Interagency Automated Data-Search System in a defined way and the active status of that information should be updated when the relevant grounds are removed.
